unyielding in asserting that federal law holds marijuana illegal under
all circumstances and trumps all state and local medical cannabis laws,
Burns nonetheless advised Arcatans to “defer 100 percent good judgment
of the people who have been elected and appointed” while motioning to
those present in the APD conference room. But most of them are working
on guidelines under which medical marijuana may be safely

The impending guidelines run counter to entreaties made by some
dispensary operators to the Planco at last week’s meeting. They asked
that the commission give City approval to illegal purchases of cannabis
from home gardens managed by 215 patients – this despite repeated
statements by commissioners and staff that the thrust of the new
dispensary regs would be to sever any connection to residential grows.

ARCATA – An Arcata cannabis dispensary has filed a petition in
Humboldt County Superior Court over the Planning Commission’s decision
to prohibit commercial cultivation of medical marijuana downtown. The
petition names the City of Arcata, City Council and Planning Commission
as respondents. In papers filed Tuesday, July 1, Humboldt Medical Supply (HMS)
asks that the Planco’s decision, later upheld by the City Council, be
stayed so that it may cultivate cannabis at its new facility at 855
Eighth Street next to the Arcata Post Office.

The sole Arcata search warrant was served at 1658 Virginia Way,
where FBI agents and at least one postal inspector dismantled what
appeared to be a modest grow operation. After an unknown number of
plants were confiscated, lighting and other equipment was spread out on
the home’s front lawn, inventoried and taken away.

A Friends of the Forest group did exist in the mid-i990s, using
volunteers equipped with a belt pack which contained a small folding
saw, first aid kit and brick-sized cellular phone. While parameters
have yet to be developed, today’s volunteers would likely carry a small
GPS unit as well to specify problem locations.

housing market is cooling. McKinleyville realtor Heidi Varshock was
part of a panel that analyzed the status of the county’s housing
situation. She said the market has changed dramatically, saying that
there were only 530 home sale listings in June of 2007, and this year
there are 945. Many of the listings got on the market through
foreclosures, Varshock said.
